Terms of Service

1. Acceptance of Terms

By accessing or using Zoink ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time — continued use after changes constitutes acceptance of the revised Terms.

2. Description of the Service

Zoink is an AI-powered comedy writing assistant that analyzes your text and suggests ways to make it funnier. The Service uses artificial intelligence (provided by Anthropic) to generate suggestions. AI-generated suggestions are not guaranteed to be appropriate, accurate, or funny in all contexts. You are solely responsible for reviewing and deciding whether to use any suggestion.

3. Accounts

You must create an account to use the Service beyond the public demo. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information during registration and keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

Zoink offers a free tier and paid subscription plans (Pro and Teams). By subscribing to a paid plan, you agree to the following:

• Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel before the renewal date.
• Pricing: Current prices are displayed on our Pricing page. We may change prices with 30 days' notice. Price changes take effect at the start of your next billing period.
• Payment processing: Payments are processed securely by Stripe. We do not store your credit card details. Your use of Stripe is subject to Stripe's Terms of Service.
• Failed payments: If a payment fails, your access to paid features may be suspended until the payment issue is resolved.

5. Cancellation and Refunds

• Subscription cancellation: You can cancel your subscription at any time through your Account page or via the Stripe billing portal. After cancellation, you retain access to paid features until the end of your current billing period.
• Speech Pass: The Speech Pass is a one-time purchase that grants a fixed number of analyses (15) valid for 14 days from purchase. As a digital product, Speech Pass purchases are non-refundable once any analyses have been used. If you have not used any analyses, you may request a refund within 48 hours of purchase by emailing support@zoink.app.
• 14-day money-back guarantee (subscriptions): If you are not satisfied with Zoink, you may request a full refund within 14 days of your initial subscription purchase by emailing support@zoink.app. This guarantee applies to first-time subscriptions only.
• No partial refunds: Outside the 14-day guarantee period, we do not offer partial refunds for unused time within a billing period.

6. Acceptable Use and Content Moderation

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Violate any applicable laws or regulations.
• Infringe on the intellectual property rights of others.
• Attempt to gain unauthorized access to the Service, other accounts, or related systems.
• Reverse-engineer, decompile, or otherwise attempt to extract the source code or AI models used by the Service.
• Use automated scripts, bots, or scrapers to access the Service beyond its intended API.
• Resell, sublicense, or redistribute the Service without our written permission.

Content Moderation: Zoink is designed to improve comedy writing, which inherently involves edgy, satirical, and provocative content. While our AI provider (Anthropic) applies automated safety filters to block harmful content, we recognize that comedy often pushes boundaries. However, we do not permit the use of the Service to generate content that:

• Promotes violence, hatred, or discrimination against individuals or groups.
• Contains illegal material or incites illegal activity.
• Violates the rights of others, including privacy and intellectual property.

We reserve the right to suspend or terminate accounts that violate this Acceptable Use policy. If you encounter AI-generated suggestions that you believe violate these terms, please report them to support@zoink.app.

7. Intellectual Property

• Your content: You retain full ownership of all text you submit to the Service. By using the Service, you grant us a limited license to process your text solely for the purpose of generating suggestions.
• AI suggestions: Suggestions generated by the Service are provided to you for your use. You may use, modify, and publish them freely. We do not claim ownership of AI-generated suggestions delivered to you.
• Our property: The Service itself — including its design, code, branding, and AI prompts — is owned by Zoink and protected by applicable intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not guarantee that AI-generated suggestions will be suitable, funny, appropriate, or free of errors.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability to you for any claims arising from the Service is limited to the amount you have paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time via your Account page or by contacting support@zoink.app. Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising under these Terms shall be resolved in the courts of New South Wales, Australia.
